Incident Summary:MPHFC coach Andy Orbell is accused of violating the NorCal Premier Soccer League ("NCPSL") Code of Ethics rules relating to Recruiting by sending messages to players registered for other NCPSL clubs asking them to join his team. Specifically, the allegations made in the Incident Report allege violations of the following provisions in the NCPSL Code of Ethics:
1. Rule 1 of the Responsibility to NCPSL and Member Associations
2. Rule 1 of Responsibilities Regarding Scouting and Recruiting
3. Rule 2 of Responsibilities Regarding Scouting and Recruiting
Comments:The NCPSL Code of Ethics defines Recruiting as Contact or communication with a Player who is registered to another NCPSL Club and asking or allowing them to attend a tryout outside of the NCPSL Tryout Window, attend a club Training Session, or play or guest play for any other Team, without first receiving written permission from the Director of Coaching of the Player’s Club.
In this situation, Andy Orbell, a coach at AYSO United East Bay, sent a message to a player registered at MPHFC asking the player to join his team at AYSO United Easy Bay. Mr. Orbell did not obtain the permission of the MPHFC DOC prior to sending this message. As the message was sent outside of the NCPSL Tryout Window, this violates the 2 provisions of the Code of Ethics cited above.
In defense, AYSO United East Bay raised the defense that at the time the message was sent to the player, AYSO United East Bay was not yet admitted to the NCPSL. This is unavailing because (1) a criteria looked at when evaluating new clubs is whether they have a history of following NCPSL rules, and (2) the effects of a violation carry over to when a club is accepted to the NCPSL.
The PAD Committee therefore finds that Andy Orbell has violated the NCPSL Code of Ethics. Andy Orbell is suspended for the next 6 NCPSL games played by the AYSO United East Bay 04G team. The PAD Committee recommends that the Board of Directors of NCPSL extends the length of time AYSO United East Bay remains on probation as a new club.
